Unfair Advantage Policy
We are committed to taking all reasonable measures, and to do so immediately to prevent anything that either diminishes the fun you have playing on the site, or that gives another player an unfair advantage over you when you play against them.
To this end, we forbid all unfair practices (including the use of certain types of online poker-related programs). We do this to protect our customers and the integrity of our systems.
What are unfair practices?
Unfair practices are any practice (including but not limited to the use of BOTs, AI, multiple account use and/or practices conducted in collaboration with other players) carried out by one or more players, with one or more accounts which could put any other player not engaging in such activity at a competitive disadvantage where the unfairness in such activity is due to its success being based to some extent on concealment and/or deception against such players. One way of thinking about this is to consider whether a group of peers, when presented with information about the practice, would overwhelmingly consider that practice to be unfair.
Money-dumping occurs when any player intentionally loses a poker hand to transfer his or her chips to another user. Any user who participates in or attempts to participate in money-dumping with any other player, on the BETMGM platform is subject to the immediate termination of his or her gaming account and permanent banning from the BETMGM platform. Money-dumping is an unfair practice and as such, BetMGM reserves the right to suspend the account of any player that is found to be engaged in money-dumping and is under no obligation to refund any monies to the player.
2. Multiple Accounts a/k/a Multi-accounting:
It is prohibited for a player (whether in the player’s name or another name) have multiple accounts for the sole purpose of playing both accounts at the same time. A player may only have a single gaming account for each BETMGM skin, [i.e. Party, BetMGM, and Borgata (where applicable)]. In states where multiple BETMGM skins are present, players are prohibited from playing on multiple skins simultaneously. Any player associated with multi-accounting is subject to immediate closure of all gaming accounts, permanent banning from the BETMGM platform and confiscation of funds in associated player gaming account(s). BetMGM may close all accounts without notice and may confiscate funds held in such accounts.
Any player found to be re-entering into a tournament under a different account/skin may be issued a warning or a possible suspension based on the severity of the infraction. This behavior is prohibited as it may allow the player to gain an unfair advantage on other players in tournament poker play.
A) Players may not communicate, in any form, with another player to offer an opinion related to the game or hand being played. Such communication is considered collusion, in violation of BetMGM policy.
B) BetMGM reserves the right to consider any collusion or attempt to collude between players as a material breach of BetMGM terms and conditions. BetMGM reserves the right to terminate any player’s gaming account if a player is believed to have engaged or attempted to engage in collusive activity.
C) Account Sharing/Third-party account usage- Each player on the BetMGM platform is responsible for protecting his or her login credentials. Account sharing is prohibited. .
No third party (including a relative) is permitted to use your account, to access the BetMGM platform. Any player who believes the integrity of his or her BetMGM gaming account has been compromised shall inform BetMGM immediately. BetMGM maintains no responsibility for any actions taken by a third party who gains access to any player’s gaming account. Under no circumstances will BetMGM be liable for any losses incurred by any player as a result of mishandling of a player’s access credentials by any person. All transactions and gameplay where your username and password have been entered correctly will be regarded as valid, whether authorized by you or not.
4. Rating Manipulation:
Players intentionally losing games on low stakes tables to keep their rank at a lower level than it would otherwise be.
5. Extracting Player Profiles:
Certain companies offer for sale programs specifically created to extract player profiles and then sell them in the form of enormous player databases with the promise that anyone who purchases these programs can use this information to their advantage against other players invisibly gathering information about you and then selling it to others to use when they play against you online.
These programs are based on Player hand histories and they typically use the following methods: screen-scraping, reading "Dealer Chat," and by accessing hand histories directly from individual Player's computers using the program.
The Use of AI: AI is composed of autonomous or command executed programs on a computer or network that can interact with computer systems or users, especially one designed to respond or behave like a player. BetMGM prohibits the use of AI on its platform, across its skins. All player actions taken on the BetMGM platform must be player-generated without assistance. BetMGM reserves the right to withhold funds of and deny services to any person using a prohibited tool or service.
Certain companies offer for sale programs ("BOTS") specifically created to play a game in place of an actual (human) player, and conceal its use from the other players, and avoid detection by the online gaming site. These programs are marketed by explicitly promising the prospective purchaser-user an unfair advantage over other online players not using that program. The use of BOTs is prohibited.
A bot is software that can interact with the BetMGM platform without any human input. The software calculates the best available decision then executes.
Real Time Assistance (RTA) tools – RTA tools that use software to suggest to an active player what action to take (i.e. ‘bet’ or ‘check’) are prohibited.
BetMGM reserves the right to withhold funds of and deny services to any person using a prohibited tool or service.
Do we forbid/discourage all online programs?
No, definitely not. Our own website provides programs for playing online. Our objective however, is in providing and promoting a level playing-field and the best possible user-experience for all of our Players.
How do you distinguish between Forbidden and Permitted categories of programs? Isn't it true that many of these programs are for training and improving gaming skills?
Programs that give a player an advantage over others are not something we wish to forbid. Advantage is not the issue; an unfair advantage is and we see that as deception. And so is invasion of privacy and data theft.
To begin with, our basis for distinction is not whether a particular program gives the user an advantage over non-using players, nor is it based on the particular content.
To us, the key indicia that define the class of programs we seek to eliminate from use on the Site are: deception and breach of our customers' privacy.
Nevertheless, what our customers want will always remain the primary influence on what we do about this. So for instance, we have no doubt that anything that compromises the integrity of the game or that erodes our customers' confidence about whether they will be unfairly disadvantaged while playing on our site, must be eliminated. And it's there that we direct our efforts. But our customers will always have the last word about what it is they want to play and against whom. So if our customers want to play against BOTS, then we will seriously consider this request. But again, the bottom line is that we will do whatever it takes to ensure that our customers are not deceived and that their privacy is not violated.
Instead, what we're talking about here are programs which: (i) advertise as a key feature that the buyer/user will gain an unfair advantage (quite often they even use the word "cheat") over the other players in other words, they promise to help a player to cheat; or (ii) their use by the buyer/user is intended to remain concealed from the other players and from the "operator" (i.e., the online gaming room); or (iii) steal legally protected material (e.g., player identities) that violate International Copyright Laws as well as Privacy Laws.
Granted some of the companies who make programs that we deem "forbidden" (i.e., that satisfies the criteria above) claim that the purpose of their programs is not to assist a player to cheat an online game but rather as a training aid (even though they might concede that an unscrupulous user could indeed use it for the purpose of cheating). Think for a moment about this claim. What other plausible reason is there to make and sell programs promised to give you an unfair advantage and at the same time remain concealed from the other players and the online room, and actually take the place of a player at the online table but in a way undetectable by anyone else. That aside, emphasizing one attribute to advertise their programs ("to cheat") but disavowing that attribute entirely in every other instance is dishonest, to say the least, and certainly does nothing to help the image of our industry.
So if these companies who make such claims were honest they would disable the functionality that allows use of the program to be concealed; since doing so would not compromise its claimed value.
What counter-measures are we taking to prevent the use of BOTS?
Our efforts can be divided into three separate categories: (i) identification & detection; (ii) warning/suspending offending users; and (iii) additional measures through enlarged customer choice.
Identification and detection counter-measures are in-place now and have been for some time. These efforts will continue to improve - so that we're able to more precisely detect existing BOTS, but more importantly so that as new BOTS are created/released, we can also prevent those from eroding the experience when on the website.
The use of certain programs and their websites on our systems are blocked outright. These are: WinHoldem, Holdem Memory, PokerBot plus, PokerEdge, Poker Prophecy, Poker Sherlock, PokerBot Pro, Snowie Backgammon, JellyFish Backgammon, BGBlitz, 3DFibs and GNU Backgammon.
Once identified, a player using programs in this Forbidden Category will usually be notified. In that notice, we explain what we believe this player is doing and what steps we will take if he does not stop doing it immediately. In the most extreme cases we are prepared to suspend their Account and confiscate the funds in that Account without prior notice.
Do the efforts involve "data mining" or other intrusive means to access/read files on my computer as part of these efforts?
Where we in our absolute discretion determine an unfair practice has taken place (whether an advantage has been gained or not) the person or persons responsible for that practice will face one or all of the following consequences:
Consequences of Unfair Practices:
- We may email the offender(s) and demand the immediate cessation of all unfair practices;
- We may suspend the offending account(s) for the purposes of conducting a thorough investigation into the unfair practices'
- Ultimately, we reserve the right, in our sole discretion, to terminate the offending account(s) indefinitely and for all funds in the account(s) to be forfeited (see section 5, 19, and 21 of our Terms of Service)
Effective August 19, 2021
- General Poker Etiquette:
- Queueing - Queueing is prohibited on the BetMGM platform.Queueing occurs when a player, or a group of players, intentionally try to alter or avoid specific opponents in games where registration is 'blind'.
- Ratholing – Ratholing is prohibited on the BetMGM platform. Ratholing is the act of cashing out chips from a cash game table then rebuying with a smaller amount of chips. Ratholing is considered unethical behavior.
- Blind Abuse- The player receiving the button, in a heads-up match is required to play an equal number of small blinds and big blinds. The player receiving the button in the first hand is required to finish the game in a hand where the opponent receives the button.
Any player found to be in breach of any of the above provisions may be issued a warning or a possible suspension based on the severity of the infraction.
Chat Abuse - BetMGM may provide players with a chat facility through which players can communicate with other users of the BetMGM platform. BetMGM reserves the right to review chat history and to record all statements made on such facility. A player’s use of the chat facility is subject to the following rules:
- Players shall not make any statements that are sexually explicit or grossly offensive, including expressions of bigotry, racism, hatred, or profanity.
- Players shall not make statements that are abusive, defamatory, or harassing or insulting to other users of our Service.
- Players shall not make statements that advertise, promote, or otherwise relate to any other online entities.
- Players shall not make statements about BetMGM or the Sites or any other Internet site connected to BetMGM that are untrue and/or malicious and/or damaging to BetMGM.
- BetMGM only permits the use of English within the chat facility.
- Players are prohibited from chatting about games in progress. Any chat that may influence how any player in the game might act during a hand is prohibited.
- There are two exceptions to this rule: In cash game hands which are heads up (everyone else has folded), or when the two players are the final two players remaining in a tournament, the two players involved may chat as they wish.
Upon breach by a player of any of the above provisions, BetMGM retains the right to remove a player’s chat privilege or even temporarily or permanently terminate a player’s gaming account. Termination of a player’s gaming account due to chat abuse will result in a refund to the player of any funds in excess of any amount owed to BetMGM.
PLEASE NOTE: Dissemination of any personally identifiable information via the chat facility may be visible to other BetMGM players or third parties. BetMGM is not responsible for the consequences of any voluntarily shared personally identifiable information that any player submits via the chat facility.
